Just Plain Bad Bills

April 14, 2008

Subject: HB1007 fraudulent
From: Sharon Croghan

Greetings,

I am repeating myself some with this update, but after spending the weekend examining the testimony and comments from the senators, committee members and otherwise, feel it is imperative we keep this issue before them.

Land Title, who testified during the hearing of HB1007 that they were neutral on the bill, they stated the bill essentially told them to committee a fraudulent act by requiring them to leave off the documents filed by the toll road company, thus the need for indemnification

How can a law, which clearly requires a company to commit fraud even be considered by our elected representatives? Will this set a precedent for leaving off other information, which reduces re-sale opportunities, and desirability of value of a property from title work?

We rely on the information provided in our title searches and title insurance to protect us, if something damaging is discovered after the fact of purchasing to make us whole.
HB1007 will leave property sellers and Realtors open to law suits from mislead buyers, as they are the only groups not protected by HB1007.

Even if you have emailed previously, please let our honorable senators know how wrong it would be to pass this bill.
If you are trying to sell your house or land and oppose this bill, please include that information, as one of the senators on the committee thinks you would rather sell your property, with this cloud hidden, rather than have the honor to tell the truth.
Ask them to postpone indefinitely, HB1007.

The vote on HB1007 will be 16 April 2008 in SCR 353 1:30pm, it is second on the agenda and is for action only, no testimony will be taken. Please attend if you can, as your presence would be very important.

Peace,

Sharon
