ACTION NEEDED NOW!

Please contact Governor Ritter - ask him to VETO HB1007

May 8, 2008

In 2005/2006 session, property owners fought for notification for property owners prior to purchasing property in a toll road corridor, HB1007 removes that notification; leaving notification and the responsibility of doing so and liability for not, directly to sellers. People will once again find themselves unknowingly buying property in a toll road corridor, title disclosure should continue.
Title company representative, Christopher Condi, stated in testimony in the State Veterans Affairs Committee on HB1007 the bill instructed title companies to commit a fraudulent act by requiring title companies to exclude any mention of the toll road corridor from title commitments.

HB1007 gives immunity to title companies, private toll road companies and clerk and recorders, but not to realtors or sellers.
What happened to the voiding corridors language introduced by Senator Tom Wiens? Rep. Marsha Looper insisted it be removed, making several unfounded claims of why: vested rights of PFPE, no- we proved that isn’t the case, possible loss of federal funding for a private toll road in Colorado Springs, no- the Springs Toll Road is a private toll road using private funds, finally she tried, may jeopardize a private toll road in progress in Colorado Springs, no- they are exploring creating a special district to build that road, and don’t need the private toll road statues and don’t want to have to comply with them. So, who is Rep. Looper protecting by taking out the voiding language? Only PFPE, the private toll road company she was elected to protect Eastern Coloradoans from!

The problems with the difficulty selling corridor property and diminished value will continue as the corridor’s real threat has not been eliminated, except in the mind of Rep. Looper, who I am sure will claim a victory for all sides if this bill is signed into law.

We see no benefit from the passage of HB1007 for the majority of Coloradoans, and many may be harmed in the future.

The best we can hope for is a gubernatorial veto and this is where your help is needed. We are making a formal request for a meeting with Gov. Ritter, in order to have our case heard by the governor’s office, the only way the meeting will be granted is if the governor’s office receives numerous emails, phone calls and faxes asking Governor Ritter to veto HB08-1007. Please call or fax the governs office as soon as you can asking him to veto HB1007, if you have time call and fax the Lt. Governor and the citizen’s advocate, also with the same message:

Veto HB1007 It does nothing to protect corridor residents, and hides the existence of the Super Slab corridor from potential buyers.
