NOTICE OF DEMAND TO REMOVE PROPERTY REFERENCES

From: ___________________________________ I, the undersigned, also known as Private Property Owner, am a landowner with properties called the _______________Allotment located in the Townships ______________, in the County of _________, near ___________,  in the state ___________ (hereafter known as_____________________).

It has been brought to my attention that the U.S. Department of the Interior (DOI) has allegedly included the _________________Allotment in plans for proposed uses of Said Area, including a proposal to allow *excess______________ to run on the _____________________Allotment through voiced intentions, public media, prospectuses and certain other papers.
So that there is no misunderstanding, I want to make it clear that the Department of the Interior has never received Private Property Owner’s permission to include Said Area in such plans. By including Said Area in your plans, you have placed a cloud on Said Area and clearly violated Owner’s private property rights in Said Area.
Private Property Owner’s Allotment has now been negatively impacted by your plans for Said Area, as well as through the loss of income and damage to forage and other valuable environmental resources on Said Area, due to excess __________.                  I am therefore providing this letter to serve as a formal demand that, within thirty (30) days of receiving this letter, you physically remove all excess _____________ from the __________________ Allotment.

Because Undersigned did not give any permission whatsoever to any party, including the Department of the Interior, to allow excess ___________ to run on the Said Area properties of the undersigned, in addition to the physical removal of all excess _________________, I demand that DOI erase and delete any reference to running excess ______________ on the _____________________ Allotment that could be construed as meeting with the Private Property Owner’s approval.
Because the undersigned is not employed by the Department of the Interior and has no knowledge of said organization’s specific plans or intentions, the undersigned is to be held harmless and totally exempt from any liabilities whatsoever that may result from any representation whatsoever that the DOI may have made to any persons as pertains to Said Area to the Interior Department’s plans.
In keeping with my State and Federal Constitutional rights to acquire, possess and protect my private property, including the ___________ Allotment, I hereby demand that you file a certified letter with the clerk and assessor of _____________ County, clearly documenting your complete removal of excess _____________from my property.
Should the DOI choose not to comply with my demand, I will exercise my right to seek remedy via liens, seizures or other legal actions, as may be appropriate and provided by law. Should your non-compliance result in this Private Property Owner having to take action to remove excess _______________ from Said Area or pursue legal action, you will be charged any and all associated costs – including legal fees, court costs, accrued administrative fees, gasoline, and labor costs at the rate of $55.00 per hour.
As Private Property Owner of Said Area, I expect receipt of documentation within six (6) business days following receipt of this Demand Notice, confirming that the Department of the Interior has received said Notice. I further expect confirmation within thirty-one (31) days that the Project and its allied organizations have met all terms of this Notice.
Finally, as Property Owner, I want to make it clear that exercising my right to assess possible future fees does not waive my right to collect past compensable fees from DOI.
