Stop the EPA right now!
See EPA unveils comprehensive water regs, critics decry 'power grab' -

President Obama and Gina McCarthy are engaging in private property takings without just compensation. Remember: If government could take your property legally, it would have done so years ago!

Call your representative and governor and demand they rein in President Obama and Gina McCarthy.
Fact: President Obama and Gina McCarthy can choose one of these two: 1) They're damn stupid respective of the statute definition of navigable. 2) They're a complicit part of America's Waterrunning Cartel. Regardless, their lawlessness justifies termination of their jobs!

Have your local sign maker make signs with this exact verbiage - "No Trespassing - Trespassers will be prosecuted to the fullest extent of the law - No immunity for criminal trespass by government parties." Post on your property today! Please!

Judge: Corps' MR-GO 'took'
value of properties in
St. Bernard, Lower 9th Ward

By Mark Schleifstein,
The Times-Picayune

A federal judge Friday ruled that the Army Corps of Engineers' construction and absent maintenance of the Mississippi River-Gulf Outlet channel created a "ticking time bomb" that magnified the effects of storm surge flooding in St. Bernard Parish and the Lower 9th Ward of New Orleans.

That resulted in a "temporary taking" of the value of residential, business and parish-owned property, including Rocky and Carlo's Restaurant, ruled U.S. Court of Federal Claims Judge Susan Braden. That temporary taking included flooding during Hurricane Katrina in August 2005, and intermittent flooding during Hurricanes Rita in October 2005 and Hurricanes Gustav and Ike in 2008. Are we terrified of this government?
Eventually, Drakes Bay Oyster Farm closed its doors because of the litigation and regulatory actions taken by the federal government. BY MICHAEL AMES, NEWSWEEK / JANUARY 18, 2015

..."The idea that Lunny's farm was a heavy industry that imperiled the park's wildlife was, for a while at least, the core reason for evicting him. But for the U.S. Department of the Interior (DOI), the only agency with the power to enforce full wilderness protection, there was one problem with this argument: proving it..."

WyLiberty Attorneys File Brief in Wisconsin Free Speech Case
MADISON, WI - Wyoming Liberty Group attorneys filed an amicus curiae (friend-of-the-court) brief in the Wisconsin Supreme Court today in Three Unnamed Petitioners v. Peterson, a case consolidated with two others in what has become known as the "Wisconsin John Doe Investigation." The prosecution in each case alleges illegal campaign finance coordination between political groups and ostensibly members of Wisconsin Governor Scott Walker's campaign. WyLiberty's brief argues that Wisconsin law governing coordination is unconstitutionally overbroad, and the latest effort to criminalize political participation. Click here to continue.

By Peter Menkin
Part 2 of a series to be continued ... Part 1

Peter Menkin’s conversations were held over four separate Mondays and on other days in their short durations themselves, ending in this article-interview where talking from his home office in Mill Valley, California north of San Francisco Peter Menkin offered this series of five questions. The questions were submitted to Joshua Hart in writing prior to the interview. Click here to continue.

Progressives Plan New Lawsuit to Declare Feral Horses in Wyoming ‘Wild Animals’ Under Federal Endangered Species Act

By Gene J. Koprowski

The progressive group Friends of Animals (FOA) is planning a lawsuit to have the feral horses and burros roaming Wyoming declared an “endangered species” by the federal government under the federal Endangered Species Act (7 U.S.C. § 136, 16 U.S.C. § 1531 et seq) by 2015.

Mike Harris, an attorney for FOA, based in its regional office in Denver tells LandAndWaterUSA that the militants, under the provisions of the ESA, will file the lawsuit within 12 months or so from this week. Click here to continue.

U.S. Appeals Court rules against friends of feral horses, but BLM still failing to contain problem
By Gene J. Koprowski

A federal appeals court has denied a radical activist group’s request to halt the feral horse roundup in Wyoming by the Bureau of Land Management (BLM). But the BLM is not out of the woods of controversy yet – as opponents have engaged in civil disobedience to stall the roundup. What is more, others note the agency is not properly following the advice from a federal scientific panel, whose members are appointed by the National Academy of Sciences, to contain the environmental damage caused by the hybrid horses in the American West

Lt. Colonel Tom Niichel

"I noticed a third officer off to my right a little over a hundred feet distant among some trees, he too was armed with an AR type weapon and it was trained in my general direction if not directly on me ..."

The controversy over Smart Meters has been steaming in various counties in the United States, including the County of Larimer and the area served in Colorado’s Poudre Valley Rural Electric Association where Lt. Col. Tom Niichel lives with his wife and children. He is on active duty with the United States Air Force. He does not want a Smart Meter installed in his home, which is off the military base and he has been opposed to one being installed since 2010. Click here to continue.

Whose Water Is It? Liberal Attorney Claims ‘The State’ Owns All South Platte River Water. Colorado Governor's Office Points Out That’s Not The Law. By Gene Koprowski

A leading liberal Colorado water rights attorney is claiming that “the state” government owns all of the South Platte River’s water. But the water czar for the state’s Democratic Gov. John Hickenlooper is pointing out that that opinion is not the law, and is citing references to statutes, and case law, that inform his stance in correspondence with Land And Water USA.

During a meeting of the South Platte Basin Round Table meeting last week, noted left-leaning attorney, Michael D. Shimmin, a partner in the Boulder-based firm Vranesh and Raisch, LLP, was responding to a question by rancher Chuck Sylvester. Sylvester asked the open forum exactly who was the beneficial owner of the water, when the river level was high, or when it was low. In response, Shimmin excitedly exclaimed, “the state.”

The counselor did not elaborate, but observers said there was a stunned silence in the room after the on-the-record comment, made during the public forum. Shimmin lists the South Platte Basin Round Table and the Colorado Interbasin Compact Committee among his “professional affiliations” on his official biography. The South Platte Basin Roundtable lists Shimmin as an “at large” member.

Shimmin did not respond to an e-mail asking him to elaborate on the opinion by a Land and Water USA reporter.

Obama payback to Virginia for not taking Obamacare? Former Gov. McDonnell Indicted on Spurious Charges By Gene Koprowski
I am livid over this! Team McDonnell balanced the budget in a state that was billions in debt -- and this is the payback for fighting SEIU and Obamacare. We have a budget surplus because of Bob and 200,000 new jobs -- and for this he is a criminal? Maybe there is a lone wolf state's attorney -- like Jim Garrison in the JFK years -- who has the courage to indict Obama for his true crimes against the Republic. Or better yet -- let's petition to get AG Holder indicted in the House on Articles of Impeachment. The evidence is there already.

Brandt v. United States
Contact: William Perry Pendley, 303/292-2021, Ext. 30
I have just returned from the appearance by Mountain States Legal Foundation (MSLF) before the Supreme Court of the United States on behalf of our Wyoming client, Marvin Brandt. Now that I have finished the work that piled up during my time in Washington, D.C., including fundraising efforts for 2013, I want to report to you on the arguments. Click here to continue.

Tuesday, January 14, at 11:00 EDT, MSLF Vice President and Chief Legal Officer, Steven J. Lechner, will step before the podium in the Courtroom of the Supreme Court of the United States, face the nine justices, and open with, “Mr. Chief Justice and may it please the Court.” Thus will begin the culmination of MSLF’s long battle, which began in 2006, in defense of a Wyoming man’s right not to have his private property seized by the federal government for a high-altitude trail. This is not just about MSLF’s client, Marvin Brandt; thousands of landowners across the country will be affected by the ruling of the Supreme Court, which will come later this year. In the Brandt case the United States is asking the Supreme Court to reverse a ruling the Court made in 1942, a ruling that the United States urged upon the Court! In that 1942 ruling, the Court held that railroad rights-of-way granted under an 1875 law are easements to which the United States keeps no rights. The United States no longer likes that 1942 ruling because it keeps federal agencies from seizing the private property of people like MSLF’s client, Marvin Brandt.
Here is a recent article about MSLF’s client and this case:
